Terms of service

These Terms of Service ("Terms") govern your use of the TechTailors, LLC ("TechTailors," "we," "us," or "our") website at gettechtailored.com (the "Site") and any web design, hosting, or digital marketing services we provide (the "Services"). By using the Site or engaging our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use this Site.
We may revise these Terms at any time. Your continued use of the Site or Services constitutes acceptance of any changes. The terms "you," "your," and "client" refer to all individuals or entities accessing this Site or engaging our Services.
1. Eligibility
You must be 18 years of age or older to use the Site or engage our Services. By using the Site, you represent that you have the legal authority to agree to these Terms on behalf of yourself or the organization you represent.
2. Services
TechTailors provides custom web design, development, hosting, and digital marketing services as described on our Site and in our Partnership Packet. Specific service terms, deliverables, timelines, and pricing are outlined in individual client agreements. In the event of a conflict between these Terms and a client agreement, the client agreement shall govern.
3. Intellectual property
All content on this Site — including text, graphics, logos, images, and code — is the property of TechTailors, LLC and is protected by copyright and trademark laws. You may view and print content from the Site for personal, non-commercial use only. Any other reproduction, distribution, or modification requires our prior written consent.
Client-specific work product (websites, designs, code) is governed by the ownership and licensing terms in the applicable client agreement. TechTailors' standard policy grants clients full ownership of their site code upon completion of any applicable buy-out terms, as detailed in the Partnership Packet.
4. Acceptable use
You agree not to: use the Site in any way that violates applicable law; attempt to gain unauthorized access to any part of the Site; interfere with the Site's operation or other users' access; transmit malicious code; scrape, copy, or reproduce Site content without permission; or impersonate any person or entity.
5. Client data & privacy
Your use of our Services may involve the collection and processing of personal data. Our handling of that data is governed by our Privacy Policy. Each client's data is stored in isolated databases and is never commingled with other clients' data. You retain ownership of all content and data you provide to us.
6. Payment terms
Payment terms are specified in individual client agreements. Unless otherwise agreed, invoices are due upon receipt and processed through Stripe. Late payments may result in service suspension after written notice. Reactivation after involuntary cancellation is subject to the policies described in our Partnership Packet.
7. Service level & uptime
We deploy all client sites to Cloudflare's global edge network and strive for maximum uptime. Support response times are governed by your tier's SLA. While we work diligently to maintain service availability, we do not guarantee uninterrupted access and are not liable for downtime caused by third-party providers, force majeure events, or scheduled maintenance.
8. Termination & offboarding
Either party may terminate the service relationship as described in the client agreement. Upon termination, TechTailors will assist with data export and offboarding in accordance with our Partnership Packet. Clients may exercise the lump-sum buy-out option to retain full ownership of their site code and infrastructure configuration.
9. Limitation of liability
To the maximum extent permitted by law, TechTailors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Disclaimer
The Site and Services are provided "as is" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
11. Governing law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hamilton County, Tennessee.
